Innovasjonsspiralen

Originally the book "Innovasjonsspiralen: patentrettslige, kontraktsrettslige og konkurranserettslige spørsmål ved forbedring av patenterte oppfinnelser" was submitted as the author’s thesis (ph.d) at the University of Oslo in 2010. Schjødt partner, Inger Berg Ørstavik, was awarded His Majesty the King’s Gold Medal for this work in 2011. The medal is awarded to "outstanding younger reseachers". Work which is rewarded by His Majesty the King’s Gold Medal "must be acknowledged as an effective contribution to the special field’s research literature."

With basis in the patent license agreement, the book's main theme is the interaction between patent law and competition law. It accounts for the financial basis for the patent, contract and competition law's purpose and functions. The book considers basic questions pertaining to contract law which are relevant to most license agreements, including questions on interpretations. The account pertaining to patent law is consentrated on practical questions in the demarcation between the first patentee's and later inventor's rights. Questions relating to joint ownership in patents, the study of equivalence and the terms for patent for improvements are discussed in detail.
